Terms and Conditions

Article 1: Applicability and Copyright

1.1 These general terms and conditions apply to all agreements concluded between Bart RV Productions, hereinafter referred to as "the contractor," and its clients, hereinafter referred to as "the client."

1.2 Unless otherwise agreed in writing, the provisions of the Dutch Copyright Act (Auteurswet 1912) remain in full force. The copyright of works produced by the contractor, such as videography, graphic design, and content creation, always belongs to the contractor, unless explicitly agreed otherwise in a specific license agreement.

1.3 After full payment of the assignment, the client obtains the right to use the delivered product for the intended purpose, wherever and whenever they wish, unless otherwise agreed. However, this right is non-exclusive, non-transferable, and non-sublicensable unless otherwise agreed in writing.

Article 2: Use of Music

2.1 In the production of videography or other content creation involving the use of music, the client has the option to choose between using royalty-free music or purchasing the necessary rights for the use of copyrighted music. If the client decides to use royalty-free music, it is not allowed to use the music for purposes other than the original assignment, unless otherwise agreed.

Article 3: Promotion of Assignment Results

3.1 The contractor retains the right to use the end result of an assignment, such as videography, graphic design, and content creation, for promotional purposes for its own business. In this regard, the contractor will always consult with the client regarding the publication date and manner of promotion.

3.2 If the client explicitly and in writing indicates that they do not grant permission for the use of the delivered work for the promotion of Bart RV Productions, the contractor will respect this wish and will not use the work for promotional purposes.

Article 4: Prices

4.1 The prices stated by Bart RV Productions, both online and offline, are informative and not binding. The contractor reserves the right to change prices without prior notice. Price changes do not affect ongoing agreements unless otherwise agreed in writing.

4.2 For services based on an hourly rate, Bart RV Productions uses an hourly fee. The hourly rate for hourly-based services may be increased annually based on the Dienstenprijsindex (DPI) as published by the Dutch Central Bureau of Statistics (CBS) or any other equivalent index, without prior notice to the client.

4.3 In the event of an increase in the hourly rate, Bart RV Productions will inform the client before the effective date of the rate change.

4.4 No rights can be derived from any incorrect price listings.

Article 5: Disputes and Applicable Law

5.1 Dutch law applies to all agreements between the contractor and the client.

5.2 Disputes arising from the agreement between the contractor and the client will be submitted in the first instance to the competent court in the district where Bart RV Productions is established.

Article 6: Changes to the General Terms and Conditions

6.1 Bart RV Productions reserves the right to amend or supplement these general terms and conditions. The most recent version of the general terms and conditions will always be available on the website of Bart RV Productions.

6.2 Changes to the general terms and conditions will take effect 30 days after the amended terms have been made known to the client, or at a later date as indicated in the notification.

By accepting a quote or assignment from Bart RV Productions, the client acknowledges that they have read and agreed to these general terms and conditions.
